After Tennessee's attempt to execute Christa Pike failed, NewsNation asked a legal scholar what happens next. Deborah Denno, a law professor at Fordham University, told Jesse Weber that the state may now be blocked by a rule of its own legal system: if Pike stays unconscious, she cannot be executed.
According to the segment's description, Pike survived two doses of pentobarbital and is on a ventilator. Denno's reasoning rests on the Supreme Court, which, she says, has made it clear that a condemned person has to be aware of why they are being punished. That principle goes back to Ford v. Wainwright in 1986, and Denno knows this ground well. She has spent much of her career studying execution methods, lethal injection among them.
